RATIFICATION OF REASSIGNMENT OF STUDENTS TO SCHOOLS

8. RATIFICATION OF REASSIGNMENT OF STUDENTS TO SCHOOLS
Description

Reassignment of students to schools within the county have been approved by the administration or recommended by the Student Reassignment Appeal Board, in accordance with policies of the School Board.  They are presented for formal ratification.

GENERAL ITEMS

9. CONSENT TO WAIVER OF CONFLICT
Description

The law firm of Williams Parker Harrison Dietz & Getzen has represented the School Board for many years with respect to real estate matters.  District staff is now exploring the potential acquisition of a parcel of land located in the proposed Palmer Place development owned by Kemmons Wilson.  Williams Parker has also represented Kemmons Wilson in other matters and transactions unrelated to this specific transaction.  Kemmons Wilson has signed the attached consent allowing Williams Parker to represent the School Board with respect to the potential transaction between it and the School Board.  This agenda item seeks to inform the Board of this situation and secure its approval for Williams Parker to represent the Board in this matter.



Recommendation

That the School Board consent to the waiver of conflict signed by Kemmons Wilson, waive any potential conflict, and authorize the law firm of Williams Parker Harrison Dietz & Getzen to represent the Board with respect to a potential real estate transaction involving property located in the proposed Palmer Place subdivision.

AGREEMENTS/CONTRACTS

10. APPROVAL OF SCHOOL AFFILIATION AGREEMENT BETWEEN FAWCETT MEMORIAL HOSPITAL AND THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA
Description
This Affiliation Agreement is made by and between the School Board of Sarasota County, Florida, and Fawcett Memorial Hospital.  The School offers to enrolled students a degree program in the field of Health Science; and the Hospital operates a comprehensive acute-care medical-surgical facility.  The School desires to provide to its students a clinical learning experience through the application of knowledge and skills in actual patient-centered situations in a health care facility.  The Hospital has agreed to make its facility available to the School for such purposes.

Recommendation
That the School Affiliation Agreement between the School Board of Sarasota County, Florida, and Fawcett Memorial Hospital be approved.

GRANTS

11. APPROVAL OF THE SCHOOL IMPROVEMENT INITIATIVE GRANT APPLICATION TO THE FLORIDA DEPARTMENT OF EDUCATION FOR ALTA VISTA, EMMA E. BOOKER, GLENALLEN, GOCIO, TUTTLE AND WILKINSON ELEMENTARY SCHOOLS
Description
ENTITLEMENT: Grant funds of $459,593 will provide after-school tutoring and intensive instruction in targeted areas to low-achieving students, and professional development for teachers.

Recommendation
That the School Board of Sarasota County approve the School Improvement Initiative application.

12. APPROVAL OF THE GROWING TOWARD GLOBALIZATION GRANT PROPOSAL TO THE COMMUNITY FOUNDATION OF SARASOTA COUNTY FOR LAKEVIEW ELEMENTARY SCHOOL
Description
COMPETITIVE: Grant funds of $12,967.25 will allow students and staff to learn to speak Spanish and explore multicultural issues.

Recommendation
That the School Board of Sarasota County approve the Growing Toward Globalization grant proposal.

13. APPROVAL OF THE WRITING FROM THE HEART GRANT PROPOSAL TO THE EDUCATION FOUNDATION OF SARASOTA COUNTY FOR FRUITVILLE ELEMENTARY SCHOOL
Description
COMPETITIVE: Grant funds of $4,422 will allow students to write their own plays, enhancing the school's writing goals.

Recommendation
That the School Board of Sarasota County approve the Writing from the Heart grant proposal.

14. APPROVAL OF THE SEED GRANT PROPOSAL TO THE SOUTHWEST FLORIDA WATER MANAGEMENT DISTRICT (SWFWMD) SPLASH! GRANT PROGRAM FOR SUNCOAST POLYTECHNICAL HIGH SCHOOL
Description
COMPETITIVE: Grant funds of $4,660 will provide funding for field trips so students can learn about water quality sampling and testing, as well as water conservation strategies used in agriculture.

COMPETITIVE: Grant funds of $2,036.40 will allow students to learn about water conservation and hydroponic gardening.

17. APPROVAL OF THE PICTURING AMERICA, PICTURING HOME GRANT PROPOSAL TO THE NATIONAL ENDOWMENT FOR THE HUMANITIES FOR ALL SARASOTA COUNTY SCHOOLS
Description
COMPETITIVE: Grant funds of $74,781 will provide professional development opportunities for teachers to make connections between American art and significant events, themes, and topics in the national, state and regional experience.

EXPULSIONS

18. APPROVAL OF EXPULSION CASE NO. 10-088
Description

The student listed in Expulsion Case No. 10-088, violated School Board Policy 5.34(1)(g), Disruption to School Process.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 30 of the 2009-2010 academic year.



Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, and the holding of a hearing having been waived by the student/parent, the recommendations as specified in Expulsion Case No. 10-088, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately until June 30 of the 2009-2010 academic year.

19. APPROVAL OF EXPULSION CASE NO. 09-287
Description

The student listed in Expulsion Case No. 09-287, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On February 21, 2009, the student listed in Expulsion Case No. 09-287, violated School Board Policy 5.34(1)(d), Fighting.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 4, 2010.



Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 09-287, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately until June 4 of the 2009-2010 academic year.

20. APPROVAL OF EXPULSION CASE NO. 09-345
Description
The student listed in Expulsion Case No. 09-345, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On January 29, 2009, the student listed in Expulsion Case No. 09-345, violated School Board Policy 5.34(1)(d), Fighting.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until February 5, 2010.

That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Case No. 09-345, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately until February 5 of the 2009-2010 academic year.

21. APPROVAL OF EXPULSION CASE NO. 09-161
Description

The student listed in Expulsion Case No. 09-161, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On December 3, 2008, the student listed in Expulsion Case No. 09-161, violated School Board Policy 5.321, Possession of Weapons and Other Prohibited Articles.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until January 11, 2010.



Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 09-161, to expel the student referenced therein from the Sarasota County Schools be approved effective immediately until January 11 of the 2009-2010 academic year.

22. APPROVAL OF EXPULSION CASE NO. 09-413
Description

The student listed in expulsion Case No. 09-413, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On April 30, 2009, the student listed in Case No. 09-413, violated School Board Policy 5.32, Zero Tolerance and School Board Policy 5.321, Possession of Weapons and Other Prohibited Articles.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 30, 2010.



Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 09-413, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2009-2010 academic year.

23. APPROVAL OF EXPULSION CASE NO. 10-007
Description
The student listed in Expulsion Case No. 10-007, is in violation of an accepted Settlement Agreement for alternative school placement.  On March 25, 2009, the student listed in Expulsion Case No. 10-007, violated School Board Policy 5.32, Zero Tolerance and School Board Policy 5.322, Prohibition Against Use, Sale or Possession of Alcohol or Drugs.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until May 31, 2010.

Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 10-007, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately until May 31 of the 2009-2010 academic year.

MATERIALS MANAGEMENT

24. APPROVAL OF CLASSIFICATION OF INOPERATIVE EQUIPMENT AND FURNITURE AS PROPERTY TO BE DELETED
Description
The custodians of the property (cost center heads) have certified it to be traded in on new equipment, unaccounted for, not repairable or otherwise inoperable. Property still on hand after reallocation will be salvaged for any useful parts and then sold at auction.

Recommendation
That the classification of equipment and furniture, as property to be deleted, be approved.

25. APPROVAL TO AWARD BID #0511 FOR CLEANING OF METAL ROOFS AND OTHER STRUCTURES AND SURFACES
Description
Bids for 'Cleaning of Metal Roofs and Other Structures and Surfaces' were received from eight vendors on October 20, 2009. The bid of Awnclean Diversified Services is the best low bid meeting the advertised specifications. The bid of GCSI Paintscape, Inc., was non-responsive to the requirement for cleaning of metal roofs and other structures and surfaces as their primary business. This bid is for a period of one year with the option to renew for two additional one-year periods. The funds for these services are in the capital budget allocated to the Facilities Services Department.

Recommendation
That the bid of Awnclean Diversified Services, to provide 'Cleaning of Metal Roofs and Other Structures and Surfaces' in an amount not to exceed $150,000.00, be approved for award and purchase.

26. APPROVAL TO AWARD BID #0513 FOR ELEVATOR MAINTENANCE AND SERVICE
Description
Bids to provide 'Elevator Maintenance and Service' were received from five vendors on October 22, 2009. The bid of Schindler Elevator Corporation was the best low bid meeting the advertised specifications. This bid is for a period of one year with the option to renew for two additional one-year periods. The funds for these purchases are contained in the capital budget allocated to the Facilities Services Department.

Recommendation
That the bid of Schindler Elevator Corporation, to provide 'Elevator Maintenance and Service' in an amount not to exceed $60,000.00, be approved for award and purchase.

FACILITIES

27. ACCEPTANCE OF FACILITIES SERVICES' PROJECT(S) COMPLETION AND APPROVAL OF FINAL PAYMENT TO CONTRACTORS
Description
The substantial completion dates, original and final contract amounts are summarized on the enclosure for ease of review.  All work has been completed and all required close-out documents have been received from the contractors.  The Director of Facilities Services has determined that the projects are complete in accordance with state statutes.

Recommendation
That the cited Facilities Services' projects be accepted as complete and the final payment to contractors be approved as presented.

28. ACCEPTANCE OF ANNUAL HEALTH AND SAFETY REPORT
Description

Property inspections, as mandated in the State Regulation for Educational Facilities owned/operated by the Board, are conducted by the Facilities Services Department; adjustments are initiated through the service order system or the Project Management system.  Copies of the report are available for review at the Facilities Services office.



Recommendation
That the Annual Fire Safety, Sanitation and Casualty report be accepted as filed.   

CONSTRUCTION

29. APPROVAL OF CONTRACTS WITH THE THREE (3) TOP-RANKED FIRMS FOR GEOTECHNICAL ENGINEERING AND MATERIALS TESTING, OR ANY PART THEREOF, AND THRESHOLD BUILDING INSPECTION SERVICES FOR A THREE (3)-YEAR PERIOD
Description
The scope shall include geotechnical engineering and materials testing, or any part thereof, and threshold building inspection services for the School Board of Sarasota County, Florida, for a period of three (3) years.  On 11/3/2009 (Item #21), the Board authorized negotiations with the three (3) top-ranked firms.  On 11/10/2009, the Executive Director of Construction Services and two (2) members of the Professional Services Selection Committee met with representatives of [1] Ardaman & Associates, Inc., [2] Professional Service Industries, Inc. and [3] Universal Engineering Sciences, Inc., and successfully negotiated individual contracts. These contracts have been approved by the School Board attorney and are available for review at the Construction Services Department.  The estimated cost for these services for the three (3)-year period is $1,000,000.00.  Funds are available for these services through individual project accounts.

Recommendation
That the contracts with the three (3) top-ranked firms for Geotechnical Engineering and Materials Testing, or any part thereof, and Threshold Building Inspection Services for a three (3)-year period be approved as presented.

30. APPROVAL OF CONSTRUCTION MANAGER'S PRECONSTRUCTION SERVICES CONTRACT FOR THE BOOKER HIGH SCHOOL - REBUILD PROJECT
Description

The project's scope of work shall include reconstruction of the Booker High School campus buildings and related site work.  On 11/3/2009 (Item #23), the School Board authorized negotiations with this company. On 11/4/2009, the Executive Director of Construction Services and two (2) members of the Professional Services Selection Committee (PSSC) met with a representative from Willis A. Smith Construction, Inc. to negotiate a contract for this project.  This contract covers the pre-construction portion only for this project.  The contract for construction will be negotiated separately at a later date.  This contract amount is $232,000.00.  These contract documents have been approved by the School Board attorney and are available for review at the Construction Services Department.  The construction budget is approximately $45,000,000.00.  Funds for this project are available in the capital budget account.



Recommendation

That the construction manager's preconstruction services contract for the Booker High School - Rebuild project be approved as presented.



FINANCE

31. TERMINATION OF THE EXCLUSIVE BENEFIT GOVERNMENTAL 401 (A) NONTRUSTEED RETIREMENT PLAN
Description
The Plan was established by the School Board on March 19, 1996, for the exclusive benefit of senior management that desired not to participate in the Florida Retirement System traditional pension plan.  The existence of other tax deferred pension alternatives has rendered the plan obsolete and unnecessary.

Recommendation
That the adopting Resolution and Plan Amendment attesting to the termination of the Plan be approved and executed.

32. SUSPENSION OF BOARD MEETING AND CONVENING OF ANNUAL MEETING OF THE FINANCING CORPORATION FOR THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA
Description
This annual meeting confirms and ratifies all actions taken by the officers and director of the corporation since its last meeting of the directors, and elects the Chair as President and the Superintendent as Secretary and Treasurer.   

Recommendation
That the School Board meeting be temporarily suspended and the annual meeting of the Financing Corporation for the School Board of Sarasota County, Florida, be convened.
